Lawyer says Tri-State Crematory operator suffered from mercury exposure

RINGGOLD -- The lawyer for the operator of a crematory where more than 300 uncremated human remains were found said he believes the situation can be blamed on exposure to mercury his client suffered.


McCracken Poston said he believes Ray Brent Marsh was suffering the effects of long-term exposure to mercury vapors from a poorly built ventilation system that vented gas and particles from cremations into the room where Marsh worked.


“Brent has never been able to articulate a reason to himself, to me, or to anybody as to why this happened,” Poston said.


Poston said Marsh’s behavior and health problems suffered by his late father, crematory founder Ray Marsh, match the effects of long-term exposure to mercury vapors caused by burning dental fillings during cremation. Many dental fillings are made of a compound of various metals, called dental amalgam, that includes mercury.


A test on Marsh’s hair in 2004 indicated elevated mercury and the opinion of a leading scientist supports his theory, Poston said, though he admitted it is not a definitive answer.


“Is it conclusive? No,” Poston said. “But it sure makes sense to me.”


Marsh, who authorities say dumped the bodies and passed off fake cremains to loved ones, is serving a 12-year prison sentence after pleading guilty to 787 counts of theft, abuse of a corpse, burial service fraud and making false statements.


Poston said he has submitted material supporting his theory to the state parole board. He said he is talking about it publicly because the affected families and the public deserve an explanation for Marsh’s actions.


“I hope that the release of this information can give some comfort to those who were most deeply affected by the disaster and who have been looking for answers,” he said.

But Poston’s theory is being met with skepticism.


“I think it’s to try and curry favor with the parole board and is a publicity stunt,” District Attorney Herbert Franklin said Tuesday. “If he was affected by mercury poisoning, it only affected him in what he was doing at his work. He was going to college. He was on the board of tax equalization. He was a fine, upstanding young man except for what he was doing at work.”


Chattanooga resident Joe Oden, whose wife’s body was found at the Tri-State Crematory in Noble, said he also thinks Poston is simply trying to help Marsh get paroled.

“I just don’t buy it,” Oden said of the theory. “I think it’s hogwash.”


Dr. Kris Sperry, Georgia’s chief medical examiner, said Poston’s mercury poisoning theory is not scientifically well supported.


“The affidavit, if you read it carefully, uses the words ‘if’ and ‘may’ a lot in regards to exposure to mercury,” said Sperry, who led the effort to identify the recovered bodies. “It doesn’t meet a standard of proof. You have to have information that mercury poisoning is more likely than not the cause.”


Sperry said a current blood test would reveal if Marsh has suffered overexposure to mercury. Poston said he is open to further testing.

These forms can be organized under three headings: metallic mercury (also known as elemental mercury), inorganic mercury, and organic mercury.Metallic mercury vapors or organic mercury may affect many different areas of the brain and their associated functions, resulting in a variety of symptoms. These include personality changes (irritability, shyness, nervousness), tremors, changes in vision (constriction (or narrowing) of the visual field), deafness, muscle incoordination, loss of sensation, and difficulties with memory.
This is only part of the information that I have found researching mercury.
Now my question's are -I wonder if Brent was ever treated in the past for any of these symptons and how long had it been that he was exposed to the high levels of mercury?

If mercury poisoning is the reason for this, all the family members must be suffering from the same thing. Who in their right mind would allow anyone, family or not, to leave bodies all over the property, especially if you lived there, and I agree, there's no way they couldn't know they were there.

I am not sure whom truth_hunter is referring about knowing the facts, but I don't feel I sounded uneducated. In my opinion, it doesn't matter when it was verified, it was not brought up and it didn't seem to alter any other part of his life, ie, college, work, etc. As far as knowing the bodies were there, Brent took the fall for what others knew, it just couldn't be proven. It is fine if he gets an early release because he will go straight to Tennessee and serve his time there. Giving Poston the benefit of the doubt, it sounded good.....it just doesn't fly with the "common educated every day folk" regardless of what he reads or writes.

No to the inspection - Mike Snow got them exempted.

On the mercury - I agree the medical experts should analyze and determine if this is plausible. Stranger things have happened.

I have to say that there is a very well educated man that sent his opinion concerning this along with Mr. Postons argument. Did you read it? If not, go to newschannel9.com and read the whole thing. Have you ever had a medical condition that no-one could diagnose but you knew it existed? This happens. The reason this was not diagnosed at trial is because it has just been verified. but, I mean really, who leaves bodies behind a shed in open view thinking they will not be found. I do not know if the man has been poisioned by mercury or not, but, this is very interesting and you have to admit that the guy who gave the affadavit is more educated than you correct? or are you saying you know more about mercury poisioning than him? Do not make comments before you read it all or you may make yourself sound uneducated. Now let me say this, It is very hard for me to believe that no-one noticed these bodies lying around like they were. Someone was guilty of knowing this was going on without reporting it, thats for sure.

Ken Poston needs to realize everybody doesn't have the same motivation/drive. Sure it makes more sense to get the problem fixed than to try and find places to hide the bodies, etc. Does he not realize how many kids there are in high school that go to more trouble trying to cheat on test or ending up have to work twice as hard to do makeup work instead of just doing the work in the first place. A lot of people don't think past the nose on their face and they just think "what is the easiest way RIGHT NOW".

If he were tested in 2004 and the level was "high", why didn't we hear about this during the trial? If his dad suffered from such, why did the family continue to operate such a business? If we look at it correctly, we know this is just a ploy for the attorney to get him released early from prison. There is no excuse for what he did and he should be punished. If I am not mistaken, the business would have had to undergo some type of inspection, therefore, he should have been aware of what was going on. If Poston is thinking this is a reason why Brent made the decisions he did, he is cheaper than I originally thought. It sounds to me he is trying to justify this by saying Brent wasn't in his right mind. How LAME! The only problem I see here is that Brent is taken the fall for what his mom had everthing to do with.

This is plausible. I mean, he didn't act correctly in this situation. If he has mercury poisoning then that should be diagnosed. Mercury poisoning can do a bad number on you. And there are long term effects. Why do you think they no longer make mercury thermometers? Mercury is dangerous. Women that were exposed to mercury by eating fish gave birth to children with birth defects. Mercury is a strong element with many sideffects. Maybe we should wait and see what the medical findings are in this case. If mercury is at the root of his problem, then I would hate for him to sit in jail for something he couldn't help. His hair was tested in 2004 and the mercury level was elevated according to the article. This should be looked at and dealt with by the legal system.

How do you articulate "I'm a dumba*$%"? That's probably why he can't explain why this happened. Like they said, if he was going to school and doing other things, why did the mercury exposure ONLY affect the things he did at the crematory? 'Cause he was a crook.

AMEN, why is that we are just now hearing that this is even possible, and how is it possible if the creamtion process was not being used at the time. Let's recap, 300 bodies, no ashes but plenty of mercury to go around. Not likely, Wasn't his story at first, "faulty equipment, it just wasn't working properly???? Now it is Mercury poisoning. Well If you ask me 12 years is too long for any person to have to suffer, Just take the man and show him how a creamation is supposed to work you know put him in the box, put the box in the fire and watch it burn until nothing is left except ashes. Of course that is why I am not a Judge. They wouldn't like my verdict or my punishment. I truely believe that the punishment should fit the crime, If you are paid to creamate someone, and you don't do it then you should be creamated yourself for Justice.

Riiiggghhhttt. Mercury did it.
Global warming affected Marsh maybe, mercury is more of a stretch to believe.
He didn't get much mercury from the last 300 he didn't cremate. 300. Think about it, 300 plus.
He needs to sit out the full 12 years.
Totally unbelievable!
Lawyers and bulls both make the same contribution to the methane gas and global warming problem. But bulls have more credability and common sense.
