You need to keep reading... Have you ever heard of a charge called Public Drunkenness? Unless somehow that law does not apply to high school teachers/coaches, I believe they violated it. So I guess maybe they could have been charged with that too, but they weren't. As you said yourself: "someone having them in their system is pretty good evidence that they had them in their possession."

§ 16-11-41. Public drunkenness
(a) A person who shall be and appear in an intoxicated condition in any public place or within the curtilage of any private residence not his own other than by invitation of the owner or lawful occupant, which condition is made manifest by boisterousness, by indecent condition or act, or by vulgar, profane, loud, or unbecoming language, is guilty of a misdemeanor.
(b) This Code section shall not be construed to affect the powers delegated to counties or to municipal corporations to pass laws to punish drunkenness or disorderly conduct within their respective limits.

You might start by reading O.C.G.A. § 3-3-21.1, and as far as the possession goes - if the police do a drug bust and the guy inside consumes the drugs he has, I guess you feel that he is no longer in possession and should not be arrested for possession of drugs??

Sometimes we just need to use a little common sense.

I'm not real clear on how the tobacco comment has anything to do with this situation. Pointing fingers at others doing wrong really doesn't make these guys look any better.

And I didn't realize it was called being ambushed when you simply face consequences for breaking the law and making a bad representation of your school. I actually thought it's the way it is supposed to be.

I guess there are two sides to every story. I was relaying the information I heard from the Whitfield County Sheriff and the Whitfield Sheriff's Dept, and obviously your information comes from those who were arrested. So we can just disagree.

So do you think Georgia schools' zero tolerance policy on alcohol is "asinine"...? Or do you just feel that they should make an exception for those who think they are above the law?

I'm not sure what you mean by "the real truth," but it seems pretty cut and dry to me. Good people make bad choices. No one deserves to be, as you say, shoved off the earth. But if we want what is right and want to make that impression on our children and teach them right and wrong, then there needs to be some serious consequences to this incident, whatever that may be.

A common misconception is that someone doesn't have to be 0.08 or greater to be arrested for public intoxication. The 0.08 or greater is the standard for "driving under the influence" or DUI. So whatever those guys registered when they did the breath test didn't really matter. The breath test, from what I understood, was to find out who in the press box had been drinking alcohol. And the reason they did the test was because the deputy got a complaint that there were some guys in the press box with the smell of alcohol on them (which is illegal on school grounds), that were being loud and using some profanity. That is what I heard the Whitfield Sheriff say on the news.

They also said on the news that Georgia schools have a zero-tolerance policy, which means what it says - ZERO TOLERANCE, for faculty and for students. I'm not sure what should happen to these guys, but I'm tired of hearing people say "they shouldn't lose their job" or that they shouldn't really be in trouble...what message does that send to our kids/students? How will the school handle the next student they catch drinking on school grounds?

These guys were representing the school, and from what I understand they were getting paid for what they were doing at the game. This is really unacceptable.

I noticed. Rob Neal was actually on the Sheriff Talk/Steve Wilson Campaign Show as Steve's campaign committee member the other night. Then a few days later we saw on the news where he was arrested. It will be interesting to see if his charges stick or if "someone" steps in and tries to take care of that for him.

There was some talk early on in this blog about obtaining records from the commissioner's office... I was just wondering if anyone has been able to obtain a copy of the county salaries?

If the officer that went out to the Marsh land was "given permission to walk around," wouldn't that be the same thing as "consent to search?" If someone gives you consent to search their property, then there is no need for a search warrant. That doesn't make much sense to me.
